Obama honors Gates on last day as defense chief (AP)

WASHINGTON ? In a city where rough-and-tumble exits rival grand entrances, a visibly moved Defense Secretary Robert Gates paused briefly at a Pentagon retirement rife with pomp and pageantry, collected himself and told his president: "You're getting pretty good at this covert ops stuff."

Barack Obama, the eighth president Gates has served in more than 35 years at the CIA and Department of Defense, had just presented him with the prestigious Medal of Freedom. Gates teased his boss about keeping the award a surprise, noting how Obama had kept the world in the dark about his plan to bring down al-Qaida terrorist leader Osama bin Laden.

Giving the lie to the old adage about no second acts in America, the 67-year-old Gates had an encore retirement Thursday, with considerably more fanfare than accompanied his initial departure from Washington in 1993 to become president of Texas A&M University. This goodbye came after Gates spent 4 1/2 years helping to manage protracted wars in Iraq and Afghanistan.

At the ceremony under brilliant blue skies outside the Pentagon, Gates bid an emotional farewell to the military. And Obama, who had kept him on as Pentagon chief at the end of the Bush administration, hailed him as "a humble American patriot, a man of common sense and decency; quite simply, one of our nation's finest public servants."

It was Gates, he said, who pressed to get more heavily armored vehicles and hunter-killer drones to the war front, and made it his mission to ensure that the department served the troops in the field "as well as they serve us."

In a surprise break from the printed program, Obama presented Gates with the medal ? the highest civilian honor he can bestow.

"I can think of no better way to express the gratitude of the nation to Bob Gates than with a very special recognition," Obama said as he asked Gates to step forward to receive the award.

"I'm deeply honored and moved by your presentation of this award," Gates responded.

Gates, who is being succeeded by CIA Director Leon Panetta, was to fly home to Washington state on a military aircraft later Thursday. But he technically remains secretary of defense until Panetta is sworn in Friday morning. Pentagon press secretary Geoff Morrell said that Gates will reimburse the department for the cost of his flight. Gates' retirement has been a long time coming. When he took the job in December 2006, he carried a clock with him that counted down his days in D.C.

But when asked by Obama to stay on in Jan. 2009, he agreed, knowing that there was still much work to be done as troops began pulling out of Iraq and pouring into Afghanistan.

Adm. Mike Mullen, chairman of the Joint Chiefs of Staff, recognized Gates' well-known penchant for blunt talk and no-nonsense style. During his four-plus years, Gates fired or forced out more than half-dozen high-ranking civilian and military leaders, including the Air Force secretary and chief of staff and the Army secretary, whom he believed failed to act on some critical issues.

"He made us think about things we hadn't considered. He made us try a little harder. He made us lead a little better," said Mullen. "He tells it straight, no bull, no fancy words."

Speaking to the crowd of dignitaries, friends and staff that wrapped around the small parade field on the north side of the Pentagon, Gates said his time as defense chief "has been the greatest honor and privilege of my life."

And, as he wrapped up his speech ? the last stop in what he acknowledged has been a "long goodbye," he looked toward his wife nearby, and smiled.

"Well, Becky, we're really going home this time."

ingredients

* 2 medium skinless, boneless chicken breast halves (about 8 ounces total)
* 1 tablespoon all-purpose flour
* 2 tablespoons olive oil
* 1 medium carrot, cut into thin bite-size strips
* 1 small red or yellow sweet pepper, cut into thin bite-size strips
* 2 cloves garlic, minced
* 1/4 teaspoon salt
* 1/4 teaspoon black pepper
* 1/3 cup dry Marsala
* 1 tablespoon snipped fresh thyme or 1/4 teaspoon dried thyme, crushed
* Hot cooked linguine (optional)

directions

1. Place each chicken piece, boned side up, between 2 pieces of plastic wrap. Working from the center to the edges, pound lightly with the flat side of a meat mallet to 1/4-inch thickness. Remove plastic wrap. Coat the chicken with flour, shaking off excess. Set aside.
2. In a large skillet heat 1 tablespoon of the oil over medium heat. Add carrot strips; cook and stir for 3 minutes. Add sweet pepper strips, garlic, salt, and black pepper. Cook and stir about 5 minutes or until vegetables are crisp-tender. Divide the vegetable mixture between 2 dinner plates. Cover and keep warm.
3. In the same skillet heat the remaining 1 tablespoon oil. Add chicken. Cook for 4 to 5 minutes or until chicken is tender and no longer pink, turning once. Place the chicken on top of cooked vegetables.
4. Add Marsala and thyme to skillet. Cook and stir for 1 minute, scraping up any crusty browned bits from bottom of skillet. Pour the Marsala mixture over chicken. If desired, serve with linguine.

Wildfire burns on NM ranch owned by Sam Donaldson (AP)

HONDO, N.M. ? A wildfire burning on part of a southern New Mexico ranch owned by veteran newsman Sam Donaldson is forcing residents to evacuate.

The fire nearly tripled in size over the past day to more than 43,000 acres Wednesday. It's burning in steep terrain.

Lincoln County sheriff's deputies and staff with the New Mexico Livestock Board are helping residents and their animals evacuate the Alamo Canyon area. Residents were advised the day before to be prepared to leave.

Crews are using bulldozers to cut fire lines and are conducting back-burns in an effort to rob fuel from the blaze.

They're getting help from several single-engine planes and a C130 air tanker.

The wildfire is believed to have been caused by lightning.

Can Charlie Sheen take back his Mercedes from Natalie Kenly?

?/?

explainer

?:?

Answers to your questions about the news.

A Mercedes. Click image to expand.The last of Charlie Sheen's "goddess"-girlfriends, Natalie Kenly, left the struggling actor last week. According to celeb gossip site TMZ, the former sitcom star demanded that she return the Mercedes he bought for her in February. Does Kenly have to give the car back?

Only if it was a loaner. Giving a gift represents an immediate and complete relinquishment of any property rights, so a true gift never has to be returned. But when couples break up, they frequently get into legal spats over whether a piece of jewelry, a pet, or even a Mercedes was really a gift in the first place. As all law students know, there are three elements?that's lawyer-talk for requirements?in gift-giving: donative intent, delivery, and acceptance. In other words, the giver must intend to give the thing away, it must actually change hands, and the recipient has to take it. (Acceptance is rarely an issue in legal disputes.) Without all three, the original owner can demand his property back.

The delivery requirement is a useful way to prove that the item was a gift. The theory is that, if a gift-giver can overcome the so-called "wrench of delivery" when handing over his property, he must really mean to give the object away. Since large items like cars and houses are too big to physically hand off, courts are satisfied with "constructive delivery." That means Sheen could have completed the legal transfer by giving Kenly a key, wrapping the car in a bow, or tucking a photograph of the car into a greeting card?although those gestures seem a little too sweet for the MaSheen.

If Sheen's case were to end up in court, his lawyers would likely focus on donative intent. They would probably argue that the car was just a loaner for Kenly to drive during the term of their relationship. Absent explicit statements indicating Sheen's purpose, the judge would have to consider circumstantial evidence like whether Sheen held title to the car in his name or if he kept his own key.

If the loaner line doesn't work, Sheen has a potential backup argument, but it's a long shot. He could argue that the car was a "gift in contemplation of marriage." Many states, including California, have special laws addressing these kinds of gifts. They're usually engagement rings, but they can be any kind of property. In the Golden State, the recipient of a gift in contemplation of marriage has to return the present if he or she is the one who breaks of the engagement or if it's broken by mutual agreement. (The states are all over the map on this issue. Some require the ring to be returned in all circumstances, while others let the recipient keep it no matter what.)

It's plausible that Sheen intended the car as an engagement gift. There were reports that he planned to unofficially marry Kenly and her co-"goddess" Rachel Oberlin soon after he gave each of them a Mercedes. Unfortunately for Sheen, California is yet to recognize polygamous marriages. That would be a difficult obstacle to overcome.
